These Terms apply to your use of the perks platform. The perks platform is provided by first direct and is operated on its behalf by MLP. These Terms do not affect or form part of any terms and conditions of any product you hold with first direct or any other member of the HSBC Group.

What is the perks platform?

The perks platform provides first direct Active Customers with information on Offers.

Who is running the perks platform?

first direct is the provider of the perks platform. MLP operate the perks platform for first direct.

Who is eligible?

Only Active Customers that are resident in the UK are eligible to use the perks platform to access Offers.

How do I sign up?

To use the perks platform, Active Customers must create a user profile when they visit the perks platform.

Who provides the Offers?

Offers may be from third parties or first direct. Offers may be subject to separate eligibility criteria and terms and conditions.

How do I redeem Offers?

To redeem an Offer, you must be eligible under the terms of the Offer and follow any instructions on the perks platform or those provided by us or the Provider.

What else do I need to know about Offers?

  • we or the Provider can change or withdraw an Offer at any time without notice.
  • offers depend on availability and any terms and conditions of the Provider.
  • you cannot sell, transfer, or exchange Offers for cash or other products or services unless allowed by the Offer terms and conditions.
  • unless stated otherwise, Offers do not cover any additional costs, such as travel, insurance, food or personal expenses.

What changes can be made?

We can change these Terms and the perks platform at any time without notice. Please check these Terms each time you use the platform to understand what applies at that time.

Can I deactivate my perks platform user account?

You can deactivate your perks platform user account at any time by contacting MLP. Once deactivated, you will lose access to the perks platform and will not be able to redeem Offers.

Can my access to the perks platform be suspended or withdrawn?

Access to the perks platform is granted to Active Customers at our discretion and we may withdraw it at any time. We’ll normally give registered Active Users 30 days’ advance notice if we withdraw the perks platform as a whole. However, we may suspend or terminate your use of the perks platform immediately without notice at any time, including if required by law or regulation or if you:

  • cease to be an Active Customer;
  • cease to be resident in the UK;
  • do not comply with these Terms or the terms of any Offer or any first direct product;
  • break the law; or
  • behave inappropriately to us or when using the perks platform or Offers. For example, you’ve acted abusively, offensively or violently towards our employees.

If your use of the perks platform is suspended or terminated, you’ll no longer be able to redeem Offers.

What are the terms of use?

You must:

  • only use the perks platform for lawful purposes and must not use the perks platform in any way that could damage the perks platform or business of first direct or MLP; and
  • keep your account username and password confidential. If you know or suspect that anyone other than you knows your details, you must tell us immediately

You must not:

  • infringe or violate any intellectual property rights in the perks platform or any material published on it;
  • conduct or enable any text or data mining or web scraping of the perks platform;
  • use the perks platform if it is not allowed by law or regulations; or
  • allow anyone else to use your account or redeem Offers.

Before you make any decision or take any action that might affect you or your personal finances, you should always consult a suitably qualified professional adviser(s) to get appropriate financial, legal, accounting, tax and other advice. You are responsible to ensure that any Offer, benefit, product or service is suitable for you and for understanding any tax consequences of accepting an Offer. Your use of the perks platform and any information accessed through the perks platform is not investment or financial advice.

What about liability?

We take reasonable care to ensure that information published on the perks platform is accurate, but neither we nor any other HSBC Group member nor MLP accepts any liability for information or Offers provided by third-parties. If you redeem an Offer from a third-party Provider, you will have a direct relationship with that Provider. We do not accept liability for any goods or services provided to you by third party Provider. You may be required to provide additional information to redeem an offer. Neither we nor any other HSBC Group member nor MLP accepts liability or responsibility for loss if the information you provide is incorrect.

These Terms do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
We and MLP are not responsible for:

  • losses caused by unexpected events (where the loss is unforeseeable);
  • delays outside our control;
  • losses that you could reasonably have avoided.

The perks platform is for personal use. You agree not to use the perks platform for business purposes. We are not liable for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We and MLP have not verified the content of any sites we link to and are not responsible for this content. If you follow links to any other website or pages this is at your own risk. We and MLP do not endorse or approve any third parties or their advice, opinions, information, products or services by including Offers on the perks platform.

How can I use content on the perks platform?

You are not entitled to copy or share the information on the perks platform other than as permitted by these Terms. The information on the perks platform is not intended for distribution to, or use by, any person in any jurisdiction where this would be contrary to law or regulation.

Copyright in all pages, screens, information and material in the perks platform is owned by or licensed to us, unless otherwise noted. You can print, copy, download or temporarily store extracts from our site for your personal information, or when you use our perks platform, but you must not alter anything. Any other use is prohibited without obtaining our prior written permission. We do not permit any other website to display all or part of the perks platform, or to link to the perks platform, without our prior written permission.

Can these Terms be transferred?

We may transfer our rights and obligations under these Terms to another organisation. We will tell you in writing if this happens and ensure that the transfer does not affect your rights under the Terms. You cannot transfer your rights and obligations under these Terms.

Which Country’s courts and laws apply?

If you live in Scotland, Scots law applies to these Terms. If you live anywhere else, English law applies. If there’s a dispute between us, you can take legal action against us in any UK court.
