Spend, Spin, Win Terms and Conditions
Who is running the Incentive Campaign?
first direct, a division of HSBC UK Bank Plc (‘we, us, our’) is the promotor of the Incentive Campaign. The Marketing Lounge Partnership (“MLP”) is fulfilling the Incentive Campaign on behalf of first direct.
What is the status of these Terms and Conditions?
By participating in the Incentive Campaign you agree to these terms.
Is there any entry fee?
No. There is no charge to participate in this Incentive Campaign.
Am I eligible?
To participate in the Incentive Campaign, you must:
- have received a personal invitation to take part in the Incentive Campaign, in the form of a personal email addressed to you, or by a member of first direct staff;
- be resident in the UK;
- be aged 18 years or over;
- hold a 1st Account with first direct;
- not be a HSBC UK, first direct or The Marketing Lounge Partnership employee or contractor involved in setting up or running this Incentive Campaign;
- make 20 transactions with the eligible 1st Account debit card, between the following periods:
• Incentive period one is: 00:01 GMT on 16 February 2024 until 23:59 GMT on 7 March 2024 (inclusive)
• Incentive period two is: 00:01 GMT on 8 March 2024 until 23:59 BST on 28 March 2024 (inclusive)
If you do not meet, or prior to completing the twenty transactions cease to meet, any of these eligibility criteria, you will not be eligible to participate in the Incentive Campaign. This is the case even if you have received an invitation to participate.
The 1st Account on which the eligible debit card is held must remain open, valid and in good standing during the incentive period and until after the incentive has been claimed and received.
How do I participate?
If you meet the eligibility criteria and complete twenty transactions within incentive period one from 00:01 GMT on 16 February 2024 until 23:59 GMT on 7 March 2024 inclusive (the “Incentive Period”), you will receive an email within 30 days of the campaign close date, inviting you to spin the wheel.
If you meet the eligibility criteria and complete twenty transactions within incentive period two from 00:01 GMT on 8 March 2024 until 23:59 BST on 28 March 2024 inclusive, you will receive a further email within 20 days of the campaign close date, inviting you to spin the wheel again.
Once you’ve spun the wheel, you’ll be notified of the prize or offer you’ve won. Your gift code will be revealed on the page following the spin. To access your code at a later date, you can access the page by logging back into the site. Entrants can use their spin up to 21 days from receiving their invitation to spin) Any attempted spin after the Closing Date will be invalid and ineligible for a prize or offer.
For joint accounts, entry is per customer not account. You will not be eligible for a prize draw entry if first direct is unable to verify that you have completed the necessary actions during the promotional period or that you meet the relevant eligibility criteria or if you are prevented or restricted from participating due to law or a technical failure of any kind (including failure of any information technology).
How are winners chosen?
Any customer who meets the eligibility criteria will be invited to spin the wheel.
Prizes and offers will be awarded on a random basis. Our decision is final and binding in all respects on all entrants and no correspondence will be entered into.
There will be a prize or offer available for every qualifying customer to win in each incentive period, as detailed below.

How long does the Incentive Campaign run?
The campaign will run over the following incentive periods, unless it is ended early by first direct.
Incentive period one is: 00:01 GMT on 16 February 2024 until 23:59 GMT on 7 March 2024 (inclusive)
Incentive period two is: 00:01 GMT on 8 March 2024 until 23:59 BST on 28 March 2024 (inclusive)
DELIVERY AND USE OF A PRIZE OR OFFER IS SUBJECT TO THE GIFT TERMS AND CONDITIONS BELOW.
Winners may be required to confirm acceptance of a prize or offer and provide additional information (for instance a delivery address) where necessary to deliver the prize or offer.
16.The Operator and/or first direct will not be responsible for any delays caused by any third parties (e.g., the postal service and internet service providers).
17.Prizes and offers do not include any costs incurred that are incidental to the fulfilment of the prize or offer, including but not limited to travel, insurance, the cost of transfers to and from airports or stations, food and drink, spending money, accommodation, tax or personal expenses.
18.Prizes and offers cannot be transferred, refunded, or exchanged for a cash alternative. The Operator reserves the right to substitute a prize or offer (or any part of them) for a prize, prizes or offers of equivalent or greater monetary value if this is necessary for reasons beyond its control.
19.In the event that there are any unwon prizes or offers from campaign one, at the time the campaign ends, these will be added to the available prizes and offers for campaign two.
Liability (ATTENTION IS DRAWN TO THIS CLAUSE):
21.Except in the case of death or personal injury arising from negligence, or in respect of fraud, the Operator and first direct their group companies, their employees, and their agents exclude responsibility and all liability to the maximum extent permitted by law, including in respect of (without limitation): a) any postponement or cancellation of the Promotion; b) any changes to, supply of or use of the prize or offer; and c) any act or default of any third party supplier, which are beyond the Operator’s and/or fist direct reasonable control.
22.Participants will have no claim or action whatsoever against the Operator and first direct, their group companies, their employees, and their agents, employees, or agencies because of participating in the Promotion.
23.The Operator and first direct reserve the right to withdraw or amend the Promotion in the event of unforeseen circumstances outside their reasonable control.
24.The Operator and first direct, their group companies, their employees, and their agents do not accept any responsibility whatsoever for any technical failure, regardless of cause, including, for example, equipment failure, network, server, computer hardware or software failure of any kind, which may restrict, delay or prevent the transmission or receipt of your entry or which may be regarded as spam or junk mail.
25.If the Operator or fist direct has grounds to suspect any entrant or third party of cheating, deception or fraudulent or un-sportsman-like conduct of any kind (including, without limitation, manipulating the Promotion or any entry) the Operator or first direct reserves the right (in their sole discretion) to disqualify any entrant, entry, or person it reasonably believes to be responsible for, or associated with such activity.
26.An entrant is responsible for the behaviour of themselves and their guest(s) whilst enjoying a prize or offer. The Operator, first direct and the prize or offer supplier have the right in their absolute discretion to exclude an entrant and/or guest(s) from participation in a prize or offer if the entrant and/or their guest(s) fail to comply with the directions of the Operator, first direct or the prize or offer supplier or acts in a manner that is dangerous to themselves or to the public or is anti-social in any manner or which causes a disturbance or nuisance to others.
General:
26.The Promotion is not sponsored, endorsed or administered by, or associated with, LinkedIn, Facebook, Instagram or Twitter or any other third party and by entering the Promotion you release LinkedIn, Facebook, Instagram or Twitter and any other third party from any action or claim or liability arising out of the Promotion. All third-party trademarks and other intellectual property rights are hereby acknowledged.
28.These Terms and Conditions shall be governed by the laws of England & Wales and the courts of England shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the Promotion except that (i) residents of Scotland may also bring proceedings in Scottish Courts, and (ii) residents of Northern Ireland may also bring proceedings in Northern Irish Courts.
29.The Operator and first direct will only use personal information provided by entrants for the purpose of administering the Promotion except as explained below in relation to photography. Please refer to the Operator’s Privacy Policy and first direct Privacy Policy for further details. Nothing in these terms and conditions shall restrict the Operator or first direct from disclosing winner information to persons enquiring where required by law (entrants may object to their information being made available in this way or request the information is reduced by contacting the Operator at dco@mlp.agency/ to the ASA, if required to do so.
30.Where prizes and offers are third party products or service those third parties’ privacy policies will also be applicable, and acceptance may be a condition of receipt of the product or service.
What else do I need to know?
These Incentive Campaign Terms apply in addition to and should be read together with the first direct 1st Account Terms and Conditions. In the event of any conflict between these Incentive Campaign Terms and the first direct 1st Account Terms, these Incentive Campaign terms will apply.
We’re not responsible for any loss or damage you incur by taking part in the Incentive Campaign unless the loss or damage is caused by our negligence.
We can change these terms or cancel the Incentive Campaign without telling you in advance if:
• required by law,
• there are reasons beyond our control, or
• there’s a fair or valid reason.
How will data be handled in relation to the Incentive Campaign?

If you win, we might ask you if we can use your information and entry in any promotional activities or publicity linked to the prize draw.

- The Gift Card is valid until 30/04/2025. The trip departure date can be after the voucher expiry date.
- Only one Gift Card can be used per booking, and cannot be used with any other vouchers issued by us in a promotional or refund capacity.
- The Gift Card can only be used on lastminute.com to book flight + hotel packages or hotel only stays (services which require payment to be made to a third party on arrival are excluded).
- It can be used for multiple bookings, until the full value is redeemed. If the total sum of the booking is less than the value of the Card, the remaining credit can be used for a new booking. Conversely, if the amount of the booking is greater than that of the Card, you can use a valid credit or debit card to pay the outstanding amount.
- The Gift Card cannot be sold or refunded, even in the event of theft or loss, nor can it be exchanged for money or other goods or services.
- It cannot be used to reserve hotels or houses where payment must be made directly at the property.
- It cannot be used to acquire post-sale services once the booking is confirmed.

National Trust Gift Card Terms and Conditions
- Gift cards can be redeemed at most National Trust properties (in England, Wales and Northern Ireland), in our shops (including our online shop), cafés, and at admission points for entry or a new membership. They can also be used for National Trust holiday bookings by telephone and when staying at a Historic House Hotel.
- Gift cards cannot be used for other telephone or online purchases such as pre bookable events at National Trust places.
- Gift cards are not valid against the purchase of more gift cards. Our gift cards cannot be accepted at certain on-site outlets not operated by the National Trust.
- If you do not spend the entire amount on the gift card the remaining balance will be updated after each purchase and shown on your printed receipt. The balance can be used against future purchases.
- Gift cards can be used as part payment for a transaction with the balance being paid by another accepted method.
- If any product purchased with a gift card is subsequently exchanged for a product of lower price or a refund, any money owing will be issued as a gift card.
- Gift cards cannot be exchanged for cash.
- The gift card is not a cheque guarantee, credit, debit or charge card. The National Trust cannot be held liable for lost or stolen cards – please protect them as you would cash.
- Your gift card will either expire 24 months after the date of issue or 24 months from the last transaction (which ever comes later). A transaction is a sale or a top up. Any remaining balance is cancelled on expiry. We reserve the right to amend terms and conditions of our gift cards at any time and take appropriate action, including cancellation of a card, if necessary, in return for an appropriate refund.
- Nothing in these terms affect your rights at law (for instance, under the Consumer Rights Act 2015). Please see the Citizens Advice website at citizensadvice.org.uk for more details.
Uber Eats Voucher Terms and Conditions
- You must have an active and valid Uber account to redeem the Gift Card.
- The Gift Card may only be redeemed via the Uber app or the UberEATS app for use within the United Kingdom in areas where Uber is available.
- The Gift Card cannot be used with family profiles or with scheduled rides.
- Please follow these steps to redeem the Gift Card in the UberEATS app: 1) Go to the profile icon in the UberEATS app; 2) Tap “Promotions”; and 3) Enter the card’s Gift Code.
- Limits may apply to your redemption of or spend using the Gift Card.
- No fees apply to the Gift Card, and Gift Card funds never expire.

Take Time: Spa Day Terms and Conditions
- This offer entitles you to a Spa Experience for one, with no obligation to purchase additional treatments or products. Please note that venues may apply a service charge, this is at the discretion of the customer and will need to be paid, by them, directly to the venue.
- The offer is based on one adult, however should your requirements differ from this standard offering, please notify our Take Time Experiences Reservations Department at the time of booking.
- Children may not solely utilise the offer. Children are subject to the venue’s terms & conditions. Age restrictions for treatments may apply.
- This offer can only be redeemed by the eligible customer this gift was issued to and cannot be transferred, gifted or sold.
- Bookings can only be made at the venues listed on the Take Time Experiences website and can only be made between 1 - 28 days in advance of the preferred booking date. Same day bookings and bookings made further than 28 days in advance cannot be accepted.
- Please refer to your accompanying correspondence for the date your Spa Experience for one needs to be booked and taken by.

- A maximum of one unique booking code can be used on a Spa Experience for one.
- Any appointments made directly with the venue/therapists will not be honoured.
- Cancellations: If following a confirmed appointment, you subsequently cancel or fail to turn up for the appointment the unique booking code will become void.
- No cash alternatives will be offered.
- Each venue has confirmed its willingness to participate within this promotion. The Promoter or any associated partner cannot be held responsible for any venue subsequently declining acceptance of a booking using the offer.
- The cost of travel to the venue is excluded from the offer and is entirely at the expense of each individual.
- Each featured and participating venue holds the right to enforce rules and guidelines to comply with public health best practices during the COVID-19 outbreak and aftermath. This can include but is not limited to reduced guest allowances and crowd management, stricter cleaning practices and rotas and social distancing rules. - The Promoter cannot be held responsible for any venue subsequently declining acceptance of a booking.
- The Promoter, its agents and distributors do not guarantee the quality and/or availability of the services offered by your chosen venue and cannot be held responsible for any resulting disagreements.
- No liability can be accepted for personal loss, damage to property or injury at featured venues. Venues/therapists provide their own public liability insurance. Individuals may take out their own private insurance.
- This promotion cannot be used in conjunction with any other promotions, discount schemes or cards generated by either the participating venues or Take Time.
- Take Time or any associated partner reserve the right to alter, amend or withdraw this offer without prior written notice at their absolute discretion.
Take Time: Hotel Stay Terms and Conditions
- This offer entitles you to a Night Away for two in a participating hotel, on an accommodation only basis, free of charge with no obligation to purchase meals or beverages. Please note that a service charge may be applied, this is at the discretion of the customer and will need to be paid by them, directly to the venue.
- The offer is based on two adults sharing a standard twin or double room. Room upgrades (e.g. to a family room) to include additional guests are chargeable and are to be paid for at the time of booking. Should your requirements differ from this standard offering, please notify our Take Time Experiences Reservations Department at time of booking.
- Children may not solely utilise the offer. Children are subject to the venue’s children rates and terms & conditions.
- This offer can only be redeemed by the eligible customer this gift was issued to and cannot be transferred, gifted or sold.
- Bookings can only be made at the venues listed on the Take Time Experiences website and can only be made between 1 - 14 days in advance of the preferred booking date. Same day bookings and bookings made further than 14 days in advance cannot be accepted.
