Who is running the Incentive Campaign?

first direct, a division of HSBC UK Bank Plc (‘we, us, our’) is the promotor of the Incentive Campaign. The Marketing Lounge Partnership (“MLP”) is fulfilling the Incentive Campaign on behalf of first direct.

What is the status of these Terms and Conditions?

By participating in the Incentive Campaign you agree to these terms.

Is there any entry fee?

No. There’s no charge to participate in the incentive campaign.

Am I eligible?

To participate, you must:

  1. have received a personal invitation to take part in the Incentive Campaign, in the form of a personal email addressed to you, or by a member of first direct staff;
  2. be resident in the UK;
  3. be aged 18 years or over;
  4. hold a 1st Account with first direct;
  5. not be a HSBC UK, first direct or The Marketing Lounge Partnership employee or contractor involved in setting up or running this Incentive Campaign;
  6. make 15 transactions with the eligible 1st Account debit card, between each of the following periods:
    • Incentive period one is: 00:01 GMT on 16 February 2024 until 23:59 GMT on 7 March 2024 (inclusive)
    • Incentive period two is: 00:01 GMT on 8 March 2024 until 23:59 BST on 28 March 2024 (inclusive)

If you do not meet, or prior to completing the fifteen transactions cease to meet, any of these eligibility criteria, you will not be eligible to participate in the Incentive Campaign. This is the case even if you have received an invitation to participate.

The 1st Account on which the eligible debit card is held must remain open, valid and in good standing during the incentive period and until after the incentive has been claimed and received.

How do I participate?

If you meet the eligibility criteria and complete fifteen transactions within the incentive period one from 00:01 GMT on 16 February 2024 to 23:59 GMT on 7 March 2024 inclusive (the “Incentive Period”), you will receive an email giving you the option to claim one of the following: Aldi eGift Card, a Sainsbury’s eGift Card, a M&S eGift Card, an Uber Eats Voucher, or a Morrisons Fuel eGift Card. All e-codes will have a £15 value. The incentive will be available to all participants who fulfil the eligibility criteria.

If you meet the eligibility criteria and complete fifteen transactions within the incentive period two from 00:01 GMT on 8 March 2024 to 23:59 GMT on 28 March 2024 inclusive (the “Incentive Period”), you will receive a further email giving you the option to claim another one of the following: Aldi e-gift card, a Sainsbury’s eGift Card, a M&S eGift Card, an Uber Eats Voucher, or a Morrisons fuel e-gift card. All e-codes will have a £15 value. The incentive will be available to all participants who fulfil the eligibility criteria.

For joint accounts, entry is per customer not account. You will not be eligible for the incentive if first direct is unable to verify that you have completed the necessary actions during the promotional period or that you meet the relevant eligibility criteria or if you are prevented or restricted from participating due to law or a technical failure of any kind (including failure of any information technology).

What is the incentive?

If you meet the eligibility criteria for the Incentive (as described above), your incentive will be available within 30 days of the campaign close date and you will receive a claim email explaining the next steps. You have 30 days to claim from the date of your claim email. Your reward terms and validity can be found alongside each reward choice found on the claim page.

Once you have claimed your reward, your choice will be sent via email within 30 days of claiming. You will have 30 days to access your reward from the date of this email and a further 30 days to keep accessing it from this date.

The Incentive is not transferable. It is your responsibility to comply with any laws requiring payment of any tax, duty or similar payment relating to the award of any incentive.

How will I know I am eligible for the incentive?

If you meet the eligibility criteria, you will receive an email explaining how to choose and claim your incentive. The issuing of the incentive and fulfilment of the campaign will be done by The Marketing Lounge Partnership, on behalf of first direct.

How long does the Incentive Campaign run?

Incentive period one is: 00:01 GMT on 16 February 2024 until 23:59 GMT on 7 March 2024 (inclusive) unless it is ended early by first direct.

Incentive period two is: 00:01 GMT on 8 March 2024 until 23:59 BST on 28 March 2024 (inclusive) unless it is ended early by first direct.

What else do I need to know?

These Incentive Campaign Terms apply in addition to and should be read together with the first direct 1st Account Terms and Conditions. In the event of any conflict between these Incentive Campaign Terms and the first direct 1st Account Terms, these Incentive Campaign terms will apply.

We’re not responsible for any loss or damage you incur by taking part in the Incentive Campaign unless the loss or damage is caused by our negligence.
We can change these terms or cancel the Incentive Campaign without telling you in advance if:
• required by law,
• there are reasons beyond our control, or
• there’s a fair or valid reason.

How will data be handled in relation to the Incentive Campaign?

If you win, we might ask you if we can use your information and entry in any promotional activities or publicity linked to the prize draw.

If you wish to unsubscribe from further emails relating to this Incentive Campaign, you can unsubscribe by clicking on the link in your Incentive Campaign email. By opting out you are opting out of receiving future rewards emails sent by MLP, relating to this offer.

  2. M&S e-Gift Cards may be used to purchase goods of a higher price than the amount on the card, on payment of the difference.
  3. Cannot be exchanged for cash or used to pay for M&S Bank services, products or outstanding card balances, made to measure shirts, personalised cards or M&S energy or to buy another Gift Card or e-Gift Card.
  4. Can be used in all M&S stores in the UK and Channel Islands, including outlet, railway, motorway and airport stores but not in BP Connect stores.
  5. Are valid for 24 months from the last transaction (transactions include balance enquiries).
  6. Any remaining balance will be cancelled on expiry of the validity period.
  7. Cannot be returned or refunded, except in accordance with your legal rights, for example in the event they are not satisfactory quality.
  8. Should be treated as cash, M&S will not accept liability if lost, stolen or damaged.

  4. Sainsbury’s eGift Cards may be redeemed in full or part payment for goods at Sainsbury’s Supermarket Ltd.
  5. eGift Cards can only be used in-store or online at www.sainsburys.co.uk for Sainsbury’s Online Groceries only.
  6. eGift Cards cannot be used for purchases over the phone, via the Sainsbury’s App, at Sainsbury’s Petrol Stations, in the pharmacy, any concession within Sainsbury’s or at any Sainsbury’s concession within third party retailers.

  9. The value of an eGift Card expires on the date shown on the eGift Card, which is 24 months from the date of initial activation. If unused within this time the card will be deemed inactive and any remaining balance lost.
  10. Treat an eGift Card as cash as it cannot be replaced if lost, damaged or stolen. Sainsbury’s is not responsible for any unauthorised use of an eGift Card.
  11. You can manage your eGift Card by registering at https://help.sainsburys.co.uk/help/products/about-sainsburys-giftcard. Registering allows you to check the balance of the eGift Card at any time.
  12. Any funds on an eGift Card are not covered by the Financial Services Compensation Scheme. In the unlikely event of the issuer of this product becoming insolvent some or all funds on any eGift Card held may not be available to be spent.
  13. Sainsbury’s reserve the right to decline or withdraw eGift Cards, the right to amend these terms and conditions for eGift Card at any time and to take appropriate action, including the cancellation of the eGift Card, if, in its reasonable opinion, it deems such action necessary.

  1. If any item purchased with an ALDI Digital Gift Card is subsequently refunded or exchanged for an item of a lower value, ALDI will refund any money owed to you in cash.
  2. ALDI Digital Gift Cards: (a) cannot be exchanged for cash, change, vouchers or alternative gift cards (b) cannot be returned or refunded, except in accordance with your legal rights; and (c) are not a cheque guarantee, credit or charge card.
  3. ALDI Digital Gift Cards cannot be used for the purchase of: (a) ALDI or third party gift cards; (b) lottery tickets, scratchcards or related material; or (c) anything through ALDI’s website(s).
  4. ALDI reserves the right to refuse to accept an ALDI Digital Gift Card which ALDI believes has been duplicated or which ALDI otherwise suspects to be connected with criminal, fraudulent or malicious activity.

General Terms
Morrisons supplies both plastic gift cards (“Plastic Gift Cards”) and digital gift cards (“eGift Cards”) to customers, together referred to herein as (“Morrisons Gift Cards”), and are issued by Wm Morrison Supermarkets Plc, Hilmore House, Gain Lane, Bradford, West Yorkshire, BD3 7DL (registered office) (registered number 00358949) (“Morrisons”). If you have any complaints about our service or any Gift Cards you purchase from us please contact our Gift Card Customer Support on 0344 381 5042, opening hours are 8am to 8pm, 7 days a week.

Gift Cards
Morrisons Gift Cards are redeemable at any Morrisons stores within the United Kingdom (excluding Morrisons Daily stores). Morrisons Gift Cards cannot be redeemed online, and gift card and lottery purchases are excluded.
With the exception of expedited shipping fees for the delivery of Plastic Gift Cards, no additional fees will be imposed on purchasers or recipients of Morrisons Gift Cards.

Expiry of Morrisons Gift Cards
Balances on Morrisons Corporate Gift Cards will expire 12 months from the date of activation.
Balances on Morrisons Consumer Gift Cards will expire 24 months from the date of activation.

Your Rights To End The Contract
You have the right, in addition to your other rights, to cancel your order and return Plastic Gift Cards for no reason at all provided that you inform us in writing that you wish to cancel within 14 calendar days, starting on the day after the Plastic Gift Cards are delivered to you.
If you choose to cancel, then you must take reasonable care of the Plastic Gift Cards and should return them in re-saleable condition. You must return the Plastic Gift Cards to us in the original packaging to Wm Morrison Supermarkets Plc, Hilmore House, Gain Lane, Bradford, West Yorkshire, BD3 7DL, at your cost and risk. We advise you to ensure that the Plastic Gift Cards are adequately insured during the return journey. You will receive a full refund within 14 calendar days of us receiving the Plastic Gift Cards back from you. If you have not returned the Plastic Gift Cards within 14 calendar days of cancellation or when requested by us to do so, whichever occurs first, you will not be entitled to a refund.

Returns
Subject to the cooling off period you may not return or cancel your Morrisons Gift Cards after they are received. If you wish to cancel your Morrisons Gift Cards order prior to its delivery, please contact Customer Support.

Lost or Stolen Gift Cards
Please keep your Morrisons Gift Cards secure, as if it were cash. Morrisons is not responsible if the Morrisons Gift Cards are lost, stolen, destroyed or used without permission. Morrisons reserves the right to cancel a Morrisons Gift Cards if it reasonably suspects fraud or misconduct. Damaged, altered or cancelled Gift Card will not be accepted.

Limitations
You may not use your Morrisons Gift Cards to purchase other Morrisons Gift Cards.
Morrisons Gift Cards cannot be reloaded, resold, transferred for value, or redeemed for cash. Unused Morrisons Gift Cards may not be transferred, and orders cannot exceed £500 per day.

Morrisons Gift Cards may be paid for with a valid Debit or MasterCard (we do not accept American Express).

Delivery Information
We are not responsible for Morrisons Gift Cards that are not received due to your failure to enter an accurate physical address or email address for the recipient.

Reasons for Failed Delivery of eGift Cards
eGift Cards are delivered via email. If you have confirmed the recipient's email address but the eGift Cards have not been viewed within a reasonable period after the requested delivery date, following is a list of the most common reasons why delivery may have failed:

  1. Spam filter blocked email or routed it to a bulk/spam folder
  2. Recipient's firewall blocked the email
  3. Email inbox is over size limit
  4. Invalid email address
    If a spam filter is blocking Morrisons Gift Cards emails from getting to an inbox, the email options will need to be modified so that Morrisons Gift Cards emails are not considered spam.

Personalised Messaging
If you wish to add a personal message to your Morrisons Gift Cards, simply type your message in the message field during the purchase process.
Personal messages are limited in length to the space provided on the eGift Card, or to the space provided on the presentation carrier of Plastic Gift Cards and there is no additional charge to include a personalised message.
We reserve the right to cancel inappropriate, offensive or otherwise objectionable messages.

Governing Law
These terms are governed by English law and you can bring legal proceedings in respect of your Morrisons Gift Cards in the English courts.
